4.3.1. United States Copyright Act 1976

Under Section 107 of the United States Copyright Act 1976 – ‘Limitations on exclusive rights: Fair use’ (p.19), fair use provides for the legal, non-licensed citation or incorporation of copyrighted material in another author’s work under a four-factor balancing test:

  • the purpose and character of the use, including whether such use is of a commercial nature or is for non-profit educational purposes;
  • the nature of the copyrighted work;
  • the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  • the effect of the use upon the potential market for or value of the copyrighted work.

4.3.2. Australian Copyright Act 1968

Under Section 40(1) of the Australian Copyright Act 1968 – ‘Fair dealing for purpose of research or study’, a fair dealing with a literary work, or with an adaptation of a literary work, for the purpose of research does not constitute an infringement of copyright.

Determination of whether use or reproduction of the whole or part of a literary work, or an adaption of a literary work, constitutes fair dealing considers:

  • the purpose and character of the dealing;
  • the nature of the work or adaptation;
  • the possibility of obtaining the work or adaptation within a reasonable time at an ordinary commercial price;
  • the effect of the dealing upon the potential market for, or value of, the work or adaptation; and
  • in a case where part only of the work or adaption is reproduced – the amount and substantiality of the part copied taken in relation to the whole work or adaptation.

4.4. Seafood Free September

Our use of copyrighted material falls within guidelines of fair use and fair dealing.

We are a non-commercial, non-profit educational initiative and we receive no financial compensation for our efforts. Seafood Free September is a ‘labour of love’.

We use factual works, including data, results and conclusions from research papers published in scientific journals to support our arguments. We properly cite our sources and provide full and clear attribution to the author/s and/or copyright holder/owner, with appropriate and specific direction to original content.

We use small amounts of copyrighted material from individual sources for research and education, which are activities qualifying as fair use and fair dealing.

Our use of copyrighted material does not harm the current or future market for the original works cited and would not cause substantial harm to these original works if the Seafood Free September initiative was to reach a wider audience.
